Purchase rules
- General provisions
1.1 These Terms and Conditions of Purchase and Sale (hereinafter referred to as the "Terms and Conditions") set out the mutual rights, obligations and responsibilities of the person purchasing goods from www.kajfishing.lt (hereinafter referred to as the "Buyer") and UAB Krasso Baltic (hereinafter referred to as the "Seller") when the Buyer purchases goods from the online store. By purchasing goods in the online shop, the Buyer agrees to the application of these Terms and Conditions.
1.2 The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements. The Buyer will be informed of any changes, amendments or additions at the time of logging in to kajfishing.lt and will be required to re-accept the modified Terms and Conditions in order to shop in this online shop.
1.3 The right to make purchases in our online shop includes:
1.3.1. able-bodied natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
1.3.2. minors between the ages of 14 and 18, only with the consent of their parents or guardians, unless they are self-reliant;
1.3.3. legal persons;
1.3.4. authorised representatives of all the above.
1.4 By accepting the Terms and Conditions, the Buyer confirms that, in accordance with Clause 1.4 of the Terms and Conditions, the Buyer is entitled to purchase goods from the kajfishing.lt online shop.
- Protection of personal data
2.1 There are two ways for the Customer to order goods from kajfishing.lt:
2.1.1. by registering on this website, entering your email address and password;
2.1.2. without registering on this website.
2.2.When ordering the Goods, both in accordance with Clauses 2.1.1. and 2.1.2. of the Rules, the Buyer shall indicate in the relevant information fields provided by the Seller the following personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.
2.3.If the Buyer agrees, his/her personal data referred to in point 2.2 may be processed by kajfishing.lt for direct marketing purposes. The Buyer has the option to opt in or out of receiving newsletters and special offers during registration.
2.4 By consenting to the processing of his/her personal data for the purpose of the sale of goods and services in the Seller's online shop, the Buyer also consents to the sending of information messages to the e-mail address and telephone number he/she has provided, which are necessary for the execution of the order of goods.
2.5 The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners providing delivery or other services related to the proper execution of the order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided for by the legislation of the Republic of Lithuania.
2.6.The Buyer's identity document and the Buyer's data contained therein submitted to an employee of the Seller or Lietuvos Pasts shall be used only for proper identification of the Buyer.
- The moment of conclusion of the sale and purchase agreement
3.1 The Contract between the Buyer and the Seller shall be deemed to be concluded from the moment the Buyer, having selected the product(s) to be purchased and having created a shopping cart, clicks on the "Checkout" link.
- Buyer's rights
4.1 The Buyer shall have the right to purchase goods from kajfishing.lt online shop in accordance with these Terms and Conditions.
4.2 The Buyer shall have the right to withdraw from the contract of sale concluded with kajfishing.lt online shop by notifying the Seller in writing (by e-mail, indicating the product to be returned, its order number and the reason for the return) not later than 14 (fourteen) working days from the date of delivery.
4.3 The Buyer's right provided for in Clause 4.2 of the Rules shall be exercised in accordance with the provisions of the Civil Code and the Resolution of the Government of the Republic of Lithuania on the Approval of the Rules of the Retail Trade (11 June 2001, No. 697, 2014 edition).
4.4 The Buyer may exercise the right provided for in Clause 4.2 only if the goods have not been damaged or substantially altered in their merchantable appearance, nor have they been used.
- Duties of the buyer
5.1 The Buyer shall pay the price of the Goods and their delivery, as well as any other payments (if any, specified at the time of the conclusion of the Contract), and shall take delivery of the Goods ordered. The Buyer shall pay for the Goods through the Paysera payment system or by wire transfer quoting the order number.
5.2 If the details provided by the Buyer on the registration form change, the Buyer must update them immediately.
5.3 Once registered, the Buyer undertakes not to disclose his/her login details to any third party.
5.4 By using the kajfishing.lt online shop, the Buyer undertakes to comply with these Terms and Conditions, the other terms and conditions expressly stated in the online shop, and not to violate the legislation of the Republic of Lithuania.
- Seller's rights
6.1 If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer's access to the online shop or, in exceptional cases, to cancel the Buyer's registration, immediately and without warning.
6.2 In serious circumstances, the Seller may temporarily or permanently suspend the operation of the Online Shop without prior notice to the Buyer.
6.3`. The Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for the Goods within 2 (two) calendar days after having chosen the method of payment provided for in Clauses 8.2.1 and 8.2.2 of the Regulations.
- Seller's obligations
7.1 The Seller undertakes to enable the Buyer to use the services of the online shop kajfishing.lt under the terms and conditions set out in these Terms and Conditions and in the Online Shop.
7.2 The Seller undertakes to respect the Buyer's right to privacy of his/her personal information, i.e. to process the personal data specified by the Buyer only in accordance with the procedure set out in Section 2 of the Rules and the legislation of the Republic of Lithuania.
7.3 The Seller undertakes to deliver the Goods ordered by the Buyer to the address specified by the Buyer in accordance with the terms and conditions set out in Section 9 of the Conditions.
7.4 If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller undertakes to refund the money paid to the Buyer within 7 (seven) working days, if prepayment has been made.
7.5.If the Buyer exercises the right provided for in Clause 4.2 of the Terms and Conditions and in the event of the condition provided for in Clause 4.4 of the Terms and Conditions, the Seller undertakes to refund the money paid to the Buyer within 7 (seven) working days from the date of receipt of the returned goods.
- Prices, payment procedures and terms
8.1 The prices of the goods in the online shop and in the order form shall be quoted in euros.
8.2 The Buyer The Buyer shall pay for the Goods using one of the following methods:
8.2.1. by electronic banking using the Paysera payment system.
8.2.2. by bank transfer;
8.3 By choosing to pay by electronic banking through the Paysera payment system, the Buyer undertakes to pay immediately. Only upon receipt of payment for the goods shall the parcel of goods be formed and the delivery period commence.
- Delivery of goods
9.1 Delivery of Goods to the Buyer:
9.2.The Goods shall be delivered to the specified parcel terminal:
9.2.1 The Buyer undertakes to specify the parcel terminal to which it wishes to receive the goods.
9.2.2. the consignment shall be held at the parcel terminal for 72 hours. At the end of the period, the consignment shall be returned to the sender.
9.2.3.
9.3 Delivery of the Goods to the address specified by the Buyer:
9.3.1.The Buyer, by selecting a delivery service at the time of ordering, undertakes to specify the exact place of delivery.
9.3.2 The Buyer undertakes to accept the Goods himself. In the event that the Buyer is unable to take delivery of the Goods himself and the Goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the Goods to the wrong entity.
9.3.3 The Goods shall be delivered by the Seller or its authorised representative.
9.4 The delivery/transportation charge is based on the amount of the order. The delivery prices are shown on the kajfishing.lt website (https://kajfishing.lt/pristatymas)
9.5 The Buyer agrees that in exceptional circumstances the delivery of the Goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such event, the Seller undertakes to contact the Buyer immediately to agree the terms of delivery.
9.6 In all cases, the Seller shall be exempt from liability for breach of the time limit for delivery of the Goods if the Goods are not delivered to the Buyer, or are not delivered on time, due to the Buyer's fault or due to circumstances beyond the Buyer's control.
- Returning and exchanging goods
10.1.Defects in the goods sold shall be eliminated, defective goods shall be replaced and returned in accordance with the "Rules of Retail Trade" approved by the Government of the Republic of Lithuania by Resolution No. 697 of 11 June 2001.
10.2 In order to return the item(s), the Buyer must complete a Returns Application Form and send it by email to info@kaj.lt.
10.3 The Buyer may exercise the right provided for in Clause 10.1 within 14 (fourteen) calendar days from the date of delivery of the Goods to him by informing the Seller in accordance with the procedure provided for in Clause 10.2 of the Conditions.
10.4.The following conditions must be complied with when the Buyer returns the Goods:
10.4.1. the returned goods must be in their original packaging in good working order (this does not apply in the case of returns of low-quality goods);
10.4.2. the Goods must be undamaged by the Buyer;
10.4.3. the goods must be unused and in good condition (this does not apply in the case of returns of low-quality goods);
10.4.4. the returned goods must be in the same condition as when received by the Buyer;
10.5 The Seller shall have the right not to accept the Buyer's return of the Goods if the Buyer does not comply with the return procedure set out in this Article.
10.6 The right provided for in Clause 10.1 of the Rules may be exercised only by the Buyer who, in accordance with the provisions of the Law on Consumer Rights Protection of the Republic of Lithuania, is recognised as a consumer, i.e. a natural person who seeks to enter into contracts for purposes unrelated to his/her trade, business, trade, craft or profession (consumer purposes).
10.6.1 The Buyer (Consumer) may not exercise the right of withdrawal provided for in Clause 10.1 of the Terms and Conditions, where the contract is concluded for:
10.6.2. perishable goods or goods with a short shelf life;
10.6.3. packaged goods that have been unpacked after delivery and are unsuitable for return for health or hygiene reasons;
10.6.4. packaged video or audio recordings or packaged software that have been unpacked after delivery;
10.6.5. newspapers, magazines, journals or other periodicals;
10.6.6. participation in games or lotteries;
as well as in other cases provided for by the Civil Code, the "Rules of Retail Trade" approved by the Government of the Republic of Lithuania on 11 June 2001 by the Government of the Republic of Lithuania Resolution No. 697 and other legal acts.
10.7.Goods of inadequate quality or quality goods which the Buyer does not like the shape, size, colour, model or completeness shall be exchanged or returned in accordance with the Rules of Retail Trade approved by the Government of the Republic of Lithuania by Resolution No.697 of 11 June 2001, the Civil Code of the Republic of Lithuania, and other applicable laws of the Republic of Lithuania.
10.8 In all cases, money for returned goods shall be paid by payment order and only to the payer's bank account.
- Guarantee of product quality
11.1 The Goods shall be subject to the manufacturer's warranty of quality and/or fitness for use, the specific term (duration) and/or other terms and conditions of which, including the exclusion of the warranty, shall be specified in the descriptions of such Goods, on the packaging of the Goods, and/or in the warranty booklets provided with the Goods. If certain types of Goods are not covered by a manufacturer's quality guarantee, such Goods shall be subject to a two-year statutory guarantee and the manufacturer's commercial guarantee, which shall not limit or restrict the rights of the Purchasers under the Civil Code of the Republic of Lithuania in the event of purchase of a product of defective quality.
11.2 If the Buyer purchases Goods of unsatisfactory quality, the Buyer shall have the right to:
11.2.1. require the Seller to remedy the defects in the Goods free of charge; or
11.2.2. require the Seller to replace, free of charge, Goods of unsatisfactory quality with Goods of satisfactory quality; or
11.2.3. require the Seller to reduce the price of the Goods accordingly; or
11.2.4. unilaterally terminate the Contract and demand a refund of the price paid for the Goods.
11.3.The Buyer understands that the colour, shape and/or other parameters of the Goods displayed on the Website may not correspond to the actual shape, colour and/or other parameters of the Goods due to the technical characteristics of the device used by the Buyer. Therefore, in the event that you require further information, advice or instructions regarding our Goods, please contact the Seller directly by email at info@kaj.lt.
- Marketing measures taken by the trader
12.1 The Seller reserves the right, at its sole discretion, to introduce and/or withdraw any offers, promotions or changes to the prices of the Goods published on the Website, or to any material or content on the Website, at any time, without prejudice to the Customer's rights, including under the terms of the Contract, prior to any such change.
- Responsibility
13.1 The Buyer is fully responsible for the accuracy of the personal data provided by him. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.
13.2 The Buyer is responsible for the actions performed using this online shop.
13.3 The Seller shall be exempt from any liability where the loss is caused by the Buyer's failure to read these Terms and Conditions, notwithstanding the Seller's advice and obligations, when given the opportunity to do so.
13.4 In the event of damage, the party at fault shall indemnify the other party against direct damages.
13.5 The Seller shall not be liable for the proper performance of the obligations between the Buyer and the Seller's partners whose services the Buyer orders.
- Marketing measures taken by the trader
14.1 The Seller may, at its sole discretion, initiate various promotions on the online shop kajfishing.lt.
14.2 The Seller reserves the right, at its sole discretion, to introduce and/or withdraw offers, promotions or changes to the prices of the Goods at any time, without prejudice to the Customer's rights, including the terms of the Contract.
14.3. Discounts are not cumulative.
15. Use of cookies
15.1 In order to offer the Buyer or the visitor of the Online Shop the full range of services offered in the Online Shop, the Administrator uses system cookies in the Online Shop. Cookies are used to identify a previous visitor to the Online Shop, to determine the language of the Online Shop page, to identify the user's session and session key, as well as to identify and correct errors in the Online Shop.
16. Final provisions
16.1 These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
16.2 Relationships arising under these Rules shall be governed by the law of the Republic of Lithuania
16.3 All disagreements arising out of the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
16.4 The Buyer and the Seller agree that all disputes, claims and/or disagreements relating to the Contract or arising out of its performance, breach, termination or invalidity shall be settled by negotiation. In the event that an agreement cannot be reached by negotiation, disputes shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania, as specified in the Procedure for Use of the Website.
16.5 In case the Buyer does not agree with the Seller's response to the Buyer's written complaint, the Buyer may submit his/her request/complaint regarding the goods purchased on kajfishing.lt to the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 8 5 262 67 51, fax. (8 5) 279 1466, on the website www.vvtat.lt (as well as the territorial units of the State Consumer Rights Protection Service in the districts) - or by filling in the request form on the EGS platform https://ec.europa.eu/odr/.
16.6 The Seller has the right to change, modify or supplement the Terms and Conditions of Sale and Purchase of Goods in the manner set out in the Website Terms and Conditions of Use, and the Terms and Conditions of Sale and Purchase of Goods in force at the time of placing an order for Goods shall apply. In all cases, the Buyer undertakes to make itself aware of the Terms and Conditions of Sale of Goods at the time of placing each order for Goods by ticking the link indicating that it has read the Terms and Conditions. By doing so, the Buyer confirms that he/she has read and understood the Terms and Conditions, including the current version of the Terms and Conditions of Sale and Purchase, in force on the Website at the time of ordering the Products.
